الملخص الإنجليزي

In this research, We have dealt with the basic principles governing armed conflicts, these principles are the principle of humanity, the principle of military necessity, the principle of proportionality, the principle of discrimination, and we have the extent of the relationship between their content and their significance in international humanitarian law and the provisions and the rules of Islamic Sharia, and how it preceded international humanitarian law in dealing with the above-mentioned principles as well as necessitated respected.The problematic of this research is that, when will be the accountability of all States without exception before the International Court when contrary to the provisions of international humanitarian law.

The research has ended to emphasize the importance of the principle of humanity in armed conflicts and other principles governing armed conflict, and It must be prosecuted military and civilian leaders in case of violation of the provisions of international humanitarian law, before the International Criminal Court.
