At the beginning of the second half of the twentieth century, the legal status of non- Muslims in Morocco has changed.
Moroccan Jews in particular has moved from being a “secondary nationals” in Moroccan society to citizens.
In the aftermath of independence, the Moroccan regime started to acknowledge Jews as part of its essential “subjects”, citizens.
Through looking at historical and discursive data, this present thesis examines the historical evolution of the legal status of Jews in Morocco with reference to the relationship between religious texts and its particular manifestations in practice.
The aim is to highlight the legal status which had been obtained by the Jews in the aftermath of independence in 1956, and how and why these changes happened.
It explores the shifting relationship between the Makhzan and Jews in Morocco in legal terms as well as in the emergence of new discourses of "equality"which the Makhzan began to use to describe treatment of Jews (how Jews should be treated) between 1856 and 1956.
It focuses on two periods of the modern Morocco: 1) precolonial period starting from 1856, when Morocco singed a treaty with the Great Britain: 2) colonial period starting from 1912 until 1956, when Morocco gained independence from France.
Focusing on pre-colonial and colonial periods gives a clear picture to understanding the legal status of Jews: how it was, how it had become and how it was used during these periods.
Through details examination of historical facts and events that happened during these periods, this thesis locates how the Makhzen adopted a new radical shifting in the legal status of Jews.
Therefore, this thesis is an attempt to find an answer for questions such as how Jews moved from Dhimmis to citizens, and to what extent Jews achieve emancipation – the end to Dhimmi status.
