While preparing a manual for vehicle financing through a Murabahah structure, an Islamic bank wanted to adopt a provision of security deposit. This is an amount deposited by the customer at the time of submission of the Murabahah application and a ‘promise to purchase’ to assure the bank that the customer shall fulfill its obligation under the promise. The following queries in respect of the security deposit have been raised by the bank to the Shariah board : Is it permissible in Shariah to seek a security deposit from a customer ? At what stage of the transaction the bank can ask for security deposit ? Is there any maximum limit for the security deposit or is it left to bank’s discretion ? In case the customer does not conclude the Murabahah sale, can the bank retain the full security deposit amount ? How should this amount be treated if the Murabahah transaction is concluded successfully ?
