Prepayment is to provide the price of goods or services before getting them , it is in the sales and services , it is often done through special cards .

This research aims to the explanation of the legal obligation for that amount and related rules and provisions.

And to consider the agreement a contract, or as so like obligatory contract, it faces problematics, including: ignorance or utility and commodity price, so that is influential in the contract by prevention.

What reached the research is considering that as just a non-obligatory contract , and the sale or lease is held at each process , and considering the amount paid in advance a debt in custody seller or lessor , and the retribution happened at interpolation .

And that the paid amount is of the legal loan that does not hurt its meeting with the sale or lease
