الملخص العربي

يعتبر موضوع الدراسة من الدراسات المهمة في هذا الجانب من القانون الدستوري، كون هذه الدراسة تعالج موضوعا ذا أهمية بالغة في الدول البرلمانية، فالعلاقة بين السلطتين التشريعية و التنفيذية علاقة لا تتسم بالوضوح في بعض الأحيان، و بالأخص في الدول الحديثة، فالبرلمان العُماني يعتبر حديثا إذ تم إنشاؤه في عام 1991م، و في عام 2011م منح مجلس عمان صلاحيات رقابية تمكنه من مراقبة أعمال الحكومة، و لكن هذه الصلاحيات تحتاج لدراسة معمقة إذا ما كانت فعالة اتجاه الحكومة أم هي مجرد صلاحيات شكلية.

قام الباحث في هذه الدراسة بتناول مبدأ الفصل بين السلطات و ماهيته و مزاياه و عيوبه ثم أعطى الباحث نبذة عن السلطات الثلاث في سلطنة عمان و اختصاصاتها و مدى استقلالية كل سلطة منها.

ثم عرج الباحث في الفصل الأول بالحديث عن مظاهر الاستقلال و التعاون بين مجلس عمان و السلطة التنفيذية موضحا جوانب الاستقلال و أوجه التعاون بينهما و الأعمال المشتركة، ثم تطرق في الفصل الثاني إلى بيان ماهية الرقابة البرلمانية و وسائلها و مدى فعالية هذه الوسائل في عدة دول أوروبية و عربية.

و قام الباحث في تفصيل صلاحيات مجلس الشورى الرقابية و بيانها و مدى قوتها و في المقابل رقابة السلطة التنفيذية على البرلمان العماني، ثم خلص إلى مجموعة من النتائج والتوصيات التي يرى الباحث أهميتها لتطوير منظومة العمل البرلماني في سلطنة عمان.

الملخص الإنجليزي

The present study is considered a very important study among the studies that deal with separation of powers that is addressed by the constitutional law.

It is considered so because it deals with an issue that is considered highly important in the countries which system is parliamentary.

It should be noted that the relationship between the legislative and executive authorities is considered a vague relationship in some countries, especially in the countries that have been recently established.

In relation to Oman, the Omani parliament has been recently established.

To be specific, it was established in 1991.

In 2011, the council of Oman was given oversight powers over the government.

Such powers enable the aforementioned council to oversee the government's works.

However, these powers must be examined well to identify whether they are effective in improving the government’s performance level or serving as a matter of formality.

The researcher of the present study shed a light on the separation of powers principle.

That was done through identifying its meaning, merits and demerits.

The researcher also provided brief information about the three authorities of Oman.

He also identified the powers and independency of each authority.

Through the first chapter, the researcher identified the manifestations indicating that the executive authority and the council of Oman are independent from each other.

He also identified the manifestations of cooperation between those two authorities.

He also identified the aspects in which these two authorities are independent from each other and the aspects in which they cooperate with one another.

He also identified the duties that are in common between those two authorities.

Through the second chapter, the researcher identified the meaning of the parliamentary oversight, and its mechanisms.

He also identified the extent of effectiveness of those mechanisms in several Arab and European countries The researcher also identified in details the oversight powers given to the consultative assembly of Oman.

He also identified how powerful this assembly is.

He also identified the oversight powers given to the executive authorities over the Omani Parliament.

The researcher concluded several results and suggested several recommendations.

He believes that these recommendations are important for developing the mechanisms through which the Omani Parliament operates
