حجية علم الحاكم في الفقه الجعفري

This research deals with the knowledge of the judge in the incidents, rights, the filed suits in front of him, and how the validity of the adoption of the judge on the search as evidence for a verdict .The importance of this research lies in that it includes Identifying the type of the judicial proof system in Islam, and the ability of how to access the modem science means to access the judicial truth and approaching justice .

The research reveals that there are five theories in this matter which vary of the absolute proof like what Imama shia says, and the absolute negation like what attributed to Ibn Junaid; and the acceptance of the personal right without public according to Ibn Hamza Al-tusi and the using of the sensory science without the intuitive science according to Al-ha'iri ,the quoted without a personality , according to al-hashimi.
