The subject of medical liability; its various aspects and the multiplicity of its contents are being rich subjects for research.

Medical law and medical liability have been the interest of all specialists such as doctors, judge, scholars, lawyers, and many intellectuals and even the general public.

The main reason for this interest is the strong relation between it and the protection of health.

At the present, there are independent legal disciplines at law schools and legal research centers specialized in medical law.

In addition, there are at the faculties of medicine material relating to the ethics of the medical profession and medical liability.

Further, there are specialized judges and lawyers in this area and the medical errors became a subject of interest to the public.

This research will address the issue from a legal angle.

Evolving the basis of medical liability still raises many legal problems.

The latter is often associated with the concept of tort and contractual fault according to the traditional theory in light of the trend towards the adoption of an expanded concept of medical professional liability.

Therefore, this study aims to address the basis of medical liability in an attempt to adopt the correct concept that is based on based on the scientific and technical development of therapeutic approaches in the medical field, in addition to the outcomes that contributed significantly to the improvement of the health level and promoting it to ensure greater protection for patients without creating obstacles or burden on doctors.
