The Algerian State's need for foreign investment to improve its national economy has led to the inclusion in its national investment laws of various types of guarantees that help attract and circulate foreign capital in its territory.
What we are interested in are the legal guarantees that are the subject of our study - but the effectiveness of these, unless they are incorporated on the basis of the recognition of the principle of fair treatment and integration of foreign and domestic investors.
The conversion of Algeria to the capitalist system, has allowed the consecration of this principle in various laws on investment.
The most recent Investment Promotion Law (No.
16-09) explicitly enshrines the principle.
Consequently, the application of the latter is relative, and contains contradictions, which diminishes the meaning of this consecration.
This inevitably leads to alienation and abuse in the treatment of foreign investors.
الملخص FRE
Le besoin de l’Etat algérien pour l’investissement étranger pour améliorer son économie nationale a conduit à l’inclusion dans ses lois nationales relatives à l’investissement diverses types de garanties qui contribuent à attirer et à faire circuler des capitaux étrangers sur son territoire ;-ce qui nous intéresse, ce sont les garanties juridiques qui font l’objet de notre étude- mais l’efficacité de ces dernières, à moins qu’elles ne soient incorporées sur la base de la consécration du principe du traitement équitable et de l’intégration des investisseurs étrangers et nationaux.
La conversion de l’Algérie au système capitaliste, a permet la consécration de ce principe dans diverses lois sur l’investissement.
La toute récente loi (n° 16-09) sur la promotion de l’investissement consacre explicitement le principe.
Par conséquent, l’application de ce dernier est relative, et comporte des contradictions, ce qui diminue le sens de cette consécration.
Cela conduit inévitablement à l’aliénation et à l’abus dans le traitement des investisseurs étrangers
