Recently, the legal status of foreign investments has experienced radical changes which clearly affect the principles and fundamental guarantees .dedicated on the subject.
Such changes are made under the finance law and this, from 2009.
Among the latter, we hold in particular and especially the right of preemption, recognized by the State and by the economic public companies.
This article is designed to focus on the right of preemption, which is exercised in the liquidation phase of the foreign investment and the resulting consequences.
الملخص FRE
Le régime juridique des investissements étrangers a connu, dernièrement, des modifications radicales qui portent manifestement atteinte aux principes et aux garanties fondamentales consacrés en la matière.
De telles modifications sont apportées en vertu des lois de finances et ce, à partir de l’année 2009.
Parmi ces dernières, on retient notamment et surtout le droit de préemption, reconnu à l’Etat et aux entreprises publiques économiques.
Le présent article a pour objet de mettre l’accent sur le droit de préemption qui s’exerce en phase de liquidation de l’investissement étranger et les effets qui en découlent
