This paper deals with the study and analysis the legal nature of the decision to appoint the successful candidate to assume a public service, byaddressingthe position of administrative jurisprudence of the issue, by examining various views, and providing the preponderant view.

The position of Algerian law on this issue has also been examined, by looking the legal and regulatory texts in force, in addition to the application in the reality of to the Algerian public administration.

The papers ended with the presentation of the legal adaptation reached, as well as suggestsome recommendations and proposals to address the deficiencies in some of the relevant legal and regulatory texts.
