The legitimate competition aims to organize the activities of the economic agents and push them to offer their best resources, goods and services at the best prices in the framework of the principle of freedom of competition and equality of opportunities between them.

Thus, the legitimate competition ensures the improvement of the national production and pushes the locomotive of economic and social development.

However, these activities are not free of some anti-competitive legitimate practices, which constitute crimes that are forbidden by law because they pose a danger to the balance of the market and damage to the interests of both economic agents and consumers.

The Algerian legislator organized these crimes within special legal provisions that include deterrence to the violator such as penal sanctions, which is considered original, and transaction in some of these crimes.

Transaction in competition crimes - as legal mechanism - is one of the important economic advantages of both the state and the violator, mainly the minimization of the financial burden, gain time and effort, as well as the efficiency of financial resources collection.
