This study is an analytical study of the scope of the customs inspection, which is located during the search for any evidence related to the crime of customs smuggling, which leads some researchers to recommend legislators to reconsider the legislation in force in order to develop advanced substantive and procedural penal provisions contrary to the provisions of the traditional, to fit this crime, Criminal jurisdiction on the one hand, and to ensure that criminals do not escape punishment on the other.

The researcher reviewed the concept of customs smuggling and its distinctive legal nature from other crimes, which make the crime of smuggling a crime a special crime.

It is a financial crime at the same time.

The researcher then discussed the plan of the Jordanian legislator in the customs inspection and compared it with some comparative legislation such as the Palestinian legislation, as well as comparing it with the nature of the inspection of ordinary crime in order to explain the deficiencies and shortcomings in this plan.

Finally, the conclusion of the research included its findings and recommendations.
