الملخص العربي

قد قام الباحث بتقسيم هذه الرسالة إلى خمسة فصول، حيث تضمن الفصل الأول منها التمهيد للرسالة و مشكلتها و أهدافها، بالإضافة إلى بعض الأسئلة التي قمنا بالإجابة عنها من خلال دراستنا هذه، بالإضافة إلى حدود الدراسة و بيان لبعض المصطلحات و تعريفها، و في النهاية عرض للدراسات السابقة التي اعتمدتها الدراسة، منهجيتها و أدواتها التي تم إستخدامها و الاعتماد عليها للحصول على المعلومة.

أما الفصل الثاني، فقد تحدث به الباحث عن الموظف العام، من حيث تعريف المقصود بالموظف العام سواء بالفقه أو القضاء أو التشريع، بالإضافة إلى واجباته سواء الإيجابية أو السلبية.

الفصل الثالث، اقتصر فقط على الحديث عن التأديب من حيث تعريفة وتحديد السلطات المختصة به، بالإضافة إلى ما تضمنه من حديث عن الجريمة التأديبية و العقوبات التأديبية و المبادئ التي تحكم هذه العقوبات.

و الفصل الرابع، نجد أن التركيز به قد كان على الحكم الجزائي من حيث تعريفه وحجيته والشروط التي تقوم بها هذه الحجية.

أما فيما يخص الفصل الخامس و الأخير، فقد تضمن بعض التوصيات و النتائج التي كان الباحث قد توصل لها خلال قيامه بهذه الدراسة، بالإضافة إلى خاتمة تلخص ما ورد في الرسالة بطريقة سهلة ومبسطة للقارئ.

الملخص الإنجليزي

The researcher divided this study into five chapters by following the analytical approach of the legal texts.

The first chapter we described the problem and the objectives of the study.

In addition to some questions that we had answered through it and we have stated the limits of it, some special terms we had used and their definitions, the previous studies that we had adopted, the methodology of this study, its tools and the procedures we relied on to obtain information in this study were presented.

In the second chapter of the study, the researcher discussed the subject of the general employee and the public office in the first topic of the second chapter.

This chapter deals with the definition of the public employee and in terms of legislation, jurisprudence and judicial, in addition to his or her duties, which were divided into two types of positive and negative duties.

The study also addressed, in chapter three, the disciplinary system of the public employee, where the definition and statement of the discipline and the competent authorities were defined, and the researcher had explained the definition of the principality crime, the principles governing disciplinary penalties, and the component disciplinary authorities.

In the fourth chapter of this study, we discussed the issue of what is the penal provision and its prohibition, we defined the penal provision, and discussed its legal authentic and the conditions and bases on which the authority and justifications of the penal provisions are based.

As for the fifth and the last chapter, it includes a set of findings and recommendations that we come up with through our study of the subject of the penal impact on disciplining the public employee and contains the summary of the letter in a simple, clear way for the reader.
