For settling disputes between individuals, the legislation has established a strict judicial system based on the establishment of an ordinary and administrative judicial system and the need to follow certain procedures.

However, with the development of economic activity, the implementation of this judicial system of dispute settlement has experienced considerable development; it is also developed in terms of the adoption of a separate judicial system, on the one hand, and the creation of other mechanisms for the settlement of economic disputes on the other.

This means the existence of a special economic dispute settlement system, as one of the guarantees required and still required by the economic agents that may arise in the course of the exercise of economic activity through of an exceptional system, perhaps unknown in the settlement of other non-economic conflicts with special mechanisms and procedures.

Moreover, it is necessary to question the extent of the enabling legislation, including the Algerian legislator to set up a system of dispute settlement in economic matters.
