Foreign investment is considered as a basis for economic development.
Algeria has opened its doors to foreign investors in order to attract as many foreign investments as possible.
The Algerian legislator has adopted a legal system for the protection of foreign investment contract against non-commercial risks which are considered as one of the most important obstacles that it faces since they limit the desire of foreign investment companies to realize their projects.
Therefore, and in order to dispel the fears of the foreign investor and gain his confidence, the legislator has provided the necessary legal guarantees for its protection but these remain ineffective if they are not framed by an international mechanism which is the guarantee agreement.
However, the conclusion of this contract does not necessarily implies the attraction of foreign investments to developing countries since these depend on other factors that need to be addressed by improving the investment climate in all its aspects.
الملخص FRE
L'investissement étranger est considéré comme une base au développement économique.
L'Algérie a procédé à l'ouverture de ses portes aux investisseurs étrangers afin d'attirer le plus grand nombre possible de capitaux étrangers.
Le législateur algérien a adopté un système juridique pour la protection du contrat d'investissement étranger contre les risques non commerciaux qui sont considérés comme l'un des obstacles les plus importants auxquels il est confronté car ils limitent le désir des entreprises étrangères d'investissement de réaliser leurs projets.
Par conséquent, et afin de dissiper leurs craintes et de gagner leur confiance, le législateur a fourni les garanties juridiques nécessaires à leur protection mais celles-ci restent inefficaces si elles ne sont pas encadrées par un mécanisme international qui est le contrat de garantie Cependant, la conclusion de ce dernier n’implique pas nécessairement l’attirance d’investissements étrangers vers les pays en développement car cela dépend d’autres facteurs qui nécessitent d’être traités par l’amélioration du climat d’investissement dans tous ses aspects.
