The administration exercises its wide control over Charitable Associations according to the provisions of the Law concerning Charitable Associations (1-2000), as well as its Executive By-Law 9 of 2003.

This control amounts to the application of administrative sanctions, such as the abolition of the registration of these associations.

On the other hand,, the legislator imposed necessary restrictions to guarantee the legitimacy of the sanction.

However, in order for the success of these restrictions to be acknowledged in the way it should be, light has to be shed on them, their nature, and their usefulness.

This is added to the examination of whether or not the legislator has set the required balance between the administration’s authority and the protection of the Charitable Association in a way that leads to the achievement of public interest.
