The conflict-based approach is based on a conflict-of-laws theory that has long raised the question of seeking the relevant law on relationships with more than one law that have known different developments until most solutions have settled in current legislation.

Due process law is reached in accordance with the methodology of the base of reference by following a set of interrelated stages that ultimately lead to the disclosure of the relevant law and is assumed to be the appropriate law to govern the relationship; however, this technique after complexity appears in various stages of the search for the relevant law.
