As part of the fight against corruption, the Algerian legislator is reviewing its criminal policy on incrimination and punishment.
Since 2006, a special law has been dedicated to this end.
The text in question, embodied in Act No.
06-01 on the prevention and fight against corruption, incorporates the same provisions that previously governed certain offenses under the Penal Code.
In addition, new offenses, not previously covered by the said Code, were introduced in this special law.
It follows from this fact that a specificity of such a crime imposes itself both on the procedural and on the repressive level.
الملخص FRE
Dans le cadre de la lutte contre la corruption, le législateur algérien procède à la révision de sa politique pénale en matière d’incrimination et de sanction.
En effet, depuis 2006, une loi spéciale a été consacrée dans ce sens.
Le texte en question, concrétisé par la loi n° 06-01 relative à la prévention et à la lutte contre la corruption, reprend les mêmes dispositions régissant auparavant certaines infractions en vertu de code pénal.
En outre, de nouvelles infractions, non consacrées précédemment par ledit code, ont vu le jour dans cette loi spéciale.
Il résulte de ce fait, qu’une spécificité d’un tel crime s’impose tant sur le plan procédural que sur le plan répressif.
