الملخص الإنجليزي

This study came with the aim of identifying a very important topic which is the subject of over the authority of the administration in concluding administrative contracts through tenders in Iraqi law, and comparing them with what came in Jordanian law and iraq law and other comparative laws whenever the need arises.

And since the major projects and building of infrastructure in the state are being implemented through tenders, then the administration must improve the selection of its contractor to ensure good implementation, speedy completion and to achieve this, it must leave the administration a space of freedom to move in.

Hence the importance of the study stems from the importance that surrounds With regard to the subject of the discretionary authority of the administration and the extent of judicial oversight over it because it is the effective means by which the work is carried out or refrains from it, and through it the administration can face the new circumstances in the administrative work and develop solutions to it, especially since the legislator cannot predict when all the issuing facts and Events in the future.
