تسمح التجارة الإلكترونية بتيسير عملية تسويق المنتوج و تسريع عملية التواصل و اتخاذ القرارات و توفير نفقات و تنوع السلع و الخدمات تسهيل عملية البيع الإلكتروني و التعاقد عن بعد لهذا عمل المشرع الجزائري على تنظيم أحكام التجارة الإلكترونية بموجب القانون رقم 18-05 المؤرخ في 10 ماي 2018 غير أن عقد البيع الإلكتروني يتضمن مخاطر ترتبط بصعوبة تحديد هوية المتعاقدين و تعرض المستهلك للاحتيال و التدليس من قبل المورد الإلكتروني أو لعدم احترامه لالتزاماته التعاقدية و القانونية و من هنا تبرز أهمية البحث عن التزامات المورد في هذا النوع من التعاقد بصفته الطرف القوي لحماية المستهلك الإلكتروني و تحقيق الاستقرار في المعاملات الإلكترونية.
و نهدف من خلال هذه الدراسة تحديد التزامات المورد السابقة و اللاحقة لعقد البيع الإلكتروني و قد توصلنا في نهاية البحث أن المشرع وضع ضمانات قانونية لحماية المستهلك من خلال ضبط التزامات المورد التي تسلط عليه في حالة مخالفته لأحكام هذا القانون من أجل توفير مناخ آمن لإبرام عقود البيع الإلكترونية داخل و خارج الوطن غير أنه دون تطوير طرق الدفع الإلكترونية و تسليم البطاقة الوطنية للموردين الإلكترونيين و تنويع أشكال التجارة الإلكترونية و عدم الاكتفاء بالإعلان و الإعلام الإلكترونيين لن تحقق التجارة الإلكترونية مكانة رائدة في التشريع الجزائري

E-commerce allows facilitating the product marketing process, speeding up the process of communication and decision-making, saving the expenses and the diversity of the goods and services provided, and facilitating the electronic sale and distance contracting process.
This is why the Algerian legislature worked to regulate the provisions of e-commerce according to Law No.
Electronic selling includes risks related to the difficulty in identifying the contractors and exposing the consumer to fraud and fraud by the electronic supplier or for not respecting his contractual and legal obligations, hence the importance of researching the supplier's obligations in this type of contract as the strong party to protect the electronic consumer and achieve stability in electronic transactions.
Through this study, we aim to determine the supplier's prior and subsequent obligations to the electronic sales contract, and we have concluded at the end of the research that the legislator has put in place legal guarantees to protect the consumer by controlling the supplier's obligations and the penalties that are imposed on him in the event of his violation of the provisions of this law, with the aim of providing a safe environment for the conclusion of electronic sales contracts Inside and outside the country, however, without developing electronic payment methods, handing over the national card to electronic suppliers, and diversifying forms of e-commerce, we will only know electronic advertising and media, and e-commerce cannot achieve a leading position in Algerian legislation.
