06-03 concerned public employment, provides legal status of Trainee in articles 83 to 92.

These articles affirm that Trainee is not an employee until he is titular.

However, he has the same rights and duties as an official, except for certain positions such as assignment, placement and membership in equal-membership committees, appeal committees and technical committees.

Article 92 provides that the provisions of the Trainee will be elaborated through regulatory acts.

However, it took more than 10 years for Executive Decree 17, 322 to be issued, which detailed the provisions of Act 06.

03 concerning the status of the Trainee and the legal protection of him.

Thus, in this paper, we analyzed the 17-322 decree on how to clarify the status of the Trainee and discussed the extent to which he could limit the arbitrary practices of public institutions and administrations in confronting and protecting the Trainee in order to balance his precarious legal status.
