This research deals with the legal concept of ‘apparently understood’ of a legal text according to Ibn Hazm Al-Zahiri.
Moreover, it deals with understood ijtihad and with a focus on ijtihad based on apparent understanding of legal texts with a reference to some important and influential issues in this regard.
With this research, we will have a clear concept of understood apparent ijtihad according to Ibn Hazm Al- Zahiri with an exposition on his distinctions and specialties.
The researcher has found many results and the most important of them are: that the apparent ijtihad of Ibn Hazm is an adherence to what is stated in the text as it is stated and how it was reported to find a ruling as it was revealed.
This is because it preserves what is stated either to find a text that matches what is revealed or as proof that it contains nothing but one perspective on an issue.
It may be expressed that: the effort in seeking the intended ruling from expressed meanings that the spoken words mentioned in the Quran and Sunna with its clear mention and its necessary understanding that it can only accept one interpretation which leads to that one ruling.
This ijtihad of Hazm depends on each person depending on their ability.
These qualities are to gain deep legal understanding and study – each of which have their conditions, which must be fulfilled.
The evidence for the legal ruling on this type of ijtihad is based on the Qur’an, the Sunnah, and the consensus of the companions, before their difference and that is based on a non-judgment.
Evidence that doesn’t accept except only one interpretation and accompanying that merely makes a statement of permissibility when there is no clear mention of a command or prohibition is based on the general permissible text – that apparent ijtihad according to Ibn Hazm is that the only valid ijtihad that is rewarded for doing in every case.
That is the truth in which the mujtahid is correct certainly and whoever opposes it is mistaken according to God Most High and even if he is correct.
