Abstract EN

This study dealt with the subject of total sales entitlement according to the Islamic jurisprudence and Jordanian civil law, and the study concluded that the buyer who does not know about the entitlement in Islamic jurisprudence shall be entitled for four rights; those rights are as follows; to claim for the price from the seller, to claim for what he paid to the owner against the additions and the used benefits under his control, to claim for paid amounts to the owner against the shortage in the sales, and finally to claim expenses made from buyer's side on the sold item.

while according to Jordanian civil law, the legislator defined the buyer's rights regardless he knew about total sales entitlement or not, those rights are; the price, the improvements or good expenses made by the buyer on sold goods, the fruit or proceeds of Sales or yields and last but not least the buyer shall have the right to claim for compensation against damage caused by Sales entitlement.
