The Algerian legislator has adopted delegation as a modern method by presidential decree 15-247 of September 16, 2015 regulating public procurement and public service delegations, through articles 207 to 210.

delegating a public service is one of the methods and techniques adopted in modernizing the management of a public service in order to improve the quality of public services provided to users and achieve the public interest.

with the issuance of executive decree no.

18-199 of august 2, 2018, which includes the delegation of the public service, the legal and procedural framework for delegating the public service to the territorial authorities has been completed.

this organizational text was drafted with the aim of encouraging managers at the local level to choose the most appropriate management style and negotiate with the partner the optimal conditions for implementing the agreement to delegate the public service in the best conditions and at the lowest cost.

however, delegating the management of public service does not mean that the delegated authorities will finally abandon them.

rather, the duty of control remains in place, whether when concluding agreements or when implementing them.

the Algerian regulator has created mechanisms and ways to implement the necessary control, to ensure the transparency of procedures upon conclusion, as well as to achieve respect for the traditional and modern principles that govern the facility.
