This study aims at shedding the light on the problem of marrying the underage girls which is acceptable and permissible in Islam, but prevented from judicial and legal point of view.

However, the age of getting married for is adopted to solve any problems amongst late and current Jurists, in addition to that, Civil Status rules adopted the minimum age of getting married The researcher sees that it is important to adopt an age for getting married and preventing marrying underage girls in the judicial and legal system for what it has of negative psychological, physical and social effects, and the researcher states how important is the judge to limit the permissible for the Public interest.
