Abstract EN

This study aims at showing the keenness of the Islamic law as well as the Algerian law in protecting the spouses from falling into infidelity.

Hence, a set of preventive measures were mentioned to protect the sacred contract between the spouses, and in case they were committed to it, it will be a boost for them not to fall into the trap of infidelity crime.

The study finds that the Islamic law through its inhibitions and restrictions is considered to be the most careful law with various preventive measures that protects the spouses from falling into infidelity because the Islamic law is based on prevention is better than cure whereas the positive law is based on the punishment after the crime
