This study explores the new obligations made by the French judiciary to the professional seller in relation to the contractual clauses limiting his responsibility for safeguarding latent defects.

The judicial trends towards expanding the conventional understanding of legal texts and the establishment of judicial clues to protect the interests of unprofessional buyer, which constitutes a departure from the general rules established in the Civil Code, are also addressed.

These judicial interventions have prompted the French legislator to introduce legislative amendments to respond to these verdicts.
