The public employee's dismissal because of office neglect is considered the most serious taken administrative procedure through which he is deprived of disciplinary guarantees on the one hand and of being re-employed on the other hand.

In view of this, the Algerian legislator has subjected the dismissal of the employee for office neglect to a set of substantive and procedural rules the competent administrative authority has to take into account before issuing the dismissal decision.

These rules are considered guarantees that are granted to the employee.

If the administration violates them, the issued dismissal decision will be null void.
