Abstract EN

The Waqf is considered one of the acts of righteousness with which a person draws closer to his Lord, so he opens a door for himself from the running charities, that he benefits from in his afterlife, and fulfills the needs of people and the society in this world.

Islamic Sharia does stipulated conditions for Waqf that are not valid and enforceable except with them, It also gave the opportunity for the one who sets up Waqf programme to set whatever conditions he deems capable of carrying out his Waqf in a manner that satisfies him and achieves his interests.

These are the conditions that the jurists called "the restrictive conditions attached to the contract.

"So, what is the concept of these conditions? What is the freedom of the one who sets up Waqf programme to stipulate it? What is theire impact on the validity of the Waqf ?
