In the Constitutional Amendment of 2020, the Algerian constitutional founder created a constitutional court as an independent constitutional institution that oversees the constitutionality of laws, controls the functioning of institutions, the activity of public authorities, and other powers.

The constitutional founder also stipulated the composition of the Constitutional Court, which preserved some of the characteristics that distinguished the composition of the Constitutional Council, but it changed the composition of the composition of the Constitutional Court compared to the Constitutional Council, and also added many conditions for membership in the Constitutional Court, which were not stipulated in the composition of the Constitutional Council, The constitutional amendment also included stipulating the legal system for a member of the Constitutional Court, especially the guarantees granted to the member in a manner that guarantees the independence of the Constitutional Court in terms of membership vis-à-vis the public authorities in the state.
