Therefore, the duty must be devoted to the courts and tribunals so that the issues are not complicated and it is difficult for the judges to decide on them in the easiest and quickest way.

Study to clarify the differences between Islamic jurisprudence and Tunisian law regarding the allocation of the judiciary.

Research Methods: Comparative approach: Considering the nature of the subject, The critical approach that has been employed to show the differences and the convergence between Islamic jurisprudence and Tunisian law regarding the issue of the allocation of the judiciary, one of the issues that has not been studied in a precise manner and critique in scientific criticism indicates the foresight of the judiciary.
