Abstract EN

Most democratie political system countries tend to strengthen and reinforce the independence of local organizations /commissions.

itis one of the basis of the decentralized system, this can be done by constitution alizing the princeples of the independence of local commissions and dedicate and devote the principle of free management by giving and granting local commissions legqllylimitiedpowers and competencies this requies inventory and distribution stritpowers and rules withe consideration of the principle of independence.

Refering to the state (city ,town ,province) lawn umber 12-07 and municipal Lawn umber 10-11 decentralization has been adopted and set in governement and management.

There is no doubt that there is overlap , interference and confusion between the "wali" (force ,power ,strength)and the Mayer's (the president of the people's Assembly.

There quires determining presis elimits of their powers ccordingly, legal control must be set and established to reconcite the independence of the municipatity with the preservation of legality and the abolition of supervision and control.

La plupart des systèmes démocratiques se dirigent vers le renforcement de l'indépendance des collectivités locales.

Ce qui nécessite un partage logiques des compétences entre le centre et la périphérie.

Les lois n° 12-07 et n° 11-10 (relatives à la wilaya et à la commune) consacrent la décentralisation en matière gestion administrative, mais l'existence d'un contrôle sévère à l’égard de la commune renforce la dépendance de celle-ci vis-à-vis de la wilaya.

Il est donc plus que nécessaire d’établir une réelle décentralisation en matière de gestion et ce, en donnant plus de liberté de gestion aux assemblée locales élues.
