Pre-filing disclosure is in itially destructive of the novelty of industrial designs, with out giving importance to location, time, or method of disclosure.

Nevertheless, comparative legislation, notably French legislation, has reduced the scope of this disclosure by giving creators the possibility of protect ingits creation with in rational deadlines, and in special cases, by contrast, the Algerian legislator has decreased to a certain extent.

Level the cases of non-destructive disclosure of the novelty of industrial designs.

La divulgation antérieure au dépôt est destructrice initialement de la nouveauté des dessins et modèles industriels, sans donner l’importance au lieu, au temps, ou à la méthode de divulgation.

Néanmoins, les législations comparées, notamment la législation française, ont diminué l’étendu de cette divulgation en donnant au créateur la possibilité de protéger sa création dans des délais rationnels et dans des cas spéciaux, contrairement au législateur algérien qui a diminué à un certain niveau les cas de divulgation non destructrice de la nouveauté des dessins et modèles industriels.
