Abstract EN

The double criminalization of commercial deception constitutes a clear reflection to the importance and seriousness of the crime, as it was criminalized in virtue of the Penal Code and the Consumer Protection Law in an attempt by the Algerian legislature to set the offence and to effectively control it so that it is difficult for the perpetrators, regardless of their status, to escape from accountability and punishment .

Despite the effectiveness of double criminalization in Limiting the scope of the offense and highlighting its importance, considering that private law is complementary to public law, but it often leads to preventing from the achievement of the desired protection from criminalization, due to the difference in the wording of the two texts or the use of some different and heterogeneous words and phrases, which affects the nature of the text through the emergence of many unintended legal loopholes from the part of the legislature, that lead to the impunity.

La double criminalisation de la tromperie commerciale reflète clairement l'ampleur et la gravité de ce crime.

A ce titre, les pratiques commerciales trompeuses ont été criminalisées à la lumière du code pénal ainsi que dans le cadre de la loi relative à la protection du consommateur et à la répression des fraudes.

Toutefois, les différentes approches contenues dans les deux textes sus cités, conduit souvent à empêcher l’obtention de la protection souhaitée contre la criminalisation.

Cela est dû aux nuances qui apparaissent dans la rédaction des deux textes de lois, avec notamment l'utilisation de certains mots et expressions différents et hétérogènes, ce qui affecte la nature du texte par l'émergence de nombreuses lacunes juridiques commises involontairement par le législateur, permettant ainsi à de nombreux auteurs du crime d’échapper à la responsabilité pénale.
