بموجب المرسوم الرئاسي رقم 08-340 تم استحداث مدارس أشبال الأمة و هي مدارس عسكرية تابعة لوزارة الدفاع الوطني ذات نظام تعليمي شبه عسكري تحت الوصاية المشتركة لوزارتي الدفاع الوطني و التربية الوطنية، و قد تم إنشاء عدد منها على مستوى مختلف النواحي العسكرية، و قد أصبحت فعالة ابتداء من الدخول المدرسي 2009 / 2010.
تشتمل هذه المدارس على الطورين المتوسط و الثانوي و بالتالي فهي تستهدف فئة الأقل من 18 سنة، و هو ما يطرح مسألة توافق المدارس و أحكام القانون الدولي المتعلقة بحظر تجنيد الأطفال، خاصة أن الجزائر و لدى مصادقتها سنة 2006 على البروتوكول الاختياري الثاني الخاص بإشراك الأطفال في النزاعات المسلحة لسنة 2000 الملحق لاتفاقية حقوق الطفل لسنة 1989، ألحقتها بتصريحات تفسيرية تتعلق بأن القوانين الجزائرية ذات الصلة بتجنيد من هم أقل من 18 سنة، تتوفر على كل الضمانات اللازمة بهدف أن يكون التجنيد اختياريا، و أنه يعتمد على ترخيص من قبل الممثلين الشرعيين بناء على معرفة مستنيرة بالالتزامات التي ترتبط بالخدمة الوطنية.

According to Presidential Decree No.
08-340, the schools of "Ashbal al-Omma" were created, following the Ministry of National Defense, with a dual system ofeducation, under the joint supervision of this latter and the ministry of national education.
These schools include secondary and high school, and target under 18s, which raises the question of its compatibility with the norms of international law regarding the prohibition of recruitment of children, especially that Algeria has ratified in 2006 the Second Optional Protocol on the Involvement of Children in Armed Conflict of 2000 annexed to Convention on the Child’s Rights of 1989, with "interpretative declarations" stating that Algerian legislation on the recruitment of persons under 18 years have all the necessary guarantees to make the recruitment optional and depend on the authorization of the legitimate representative, based on the knowledge of the obligations related to the national service.

Les écoles «Ashbal al-Omma» ont été créées en vertu du décret présidentiel n° 08-340.
Dotées d'un système d'éducation mixte et placées sous la tutelle conjointe du Ministère de défense et celui de l’éducation national.
Ces écoles dispensent les programmes d’enseignement de la phase secondaire, et ciblent les moins de 18 ans, ce qui pose la question de sa compatibilité avec les normes du droit international relatives à l'interdiction de recrutement d'enfants, en sachant que l'Algérie a ratifié en 2006 le deuxième protocole facultatif concernant l'implication d'enfants dans les conflits armés de 2000 annexé à la Convention des droits de l'enfant de 1989.
