يعنى هذا البحث بتحليل الوسائل التي تمتلكها الإدارة في العراق عند اختيار المتعاقد معها لمعرفة مكامن الخلل فيها من خلال مقارنتها بالوسائل المتاحة أمام الإدارة في الدول المقارنة فرنسا و مصر و العمل على معالجة الخلل لتحصن المال العام و التقلل من ظاهرة الفساد الإداري و المالي في نطاق العقود الحكومية، و نطاقه البحث يشمل القوانين و الأنظمة و التعليمات و القرارات التي تصدرها الإدارة في العراق و في دول المقارنة و التي تكون لها علاقة بوسائل الإدارة عند اختيار المتعاقد معها، و كذلك احكام القضاء و آراء الفقهاء بهذا الخصوص.
و للإحاطة بموضوع البحث قسمناه الى مبحثين الأول خصصناه لبحث موضوع تفعيل المساواة بين المتعاقدين و الثاني لبحث موضوع اختيار الأسلوب المناسب للتعاقد.
Abstract EN
This research means analysing the means that the administration has in Iraq, when selecting a contractor with it to find out the deficiencies in it by comparing it with the means available to the administration in the comparative countries France and Egypt, and work to address the defect to protect the public money and reduce the phenomenon of administrative and financial corruption within the scope of government contracts, and the scope of research It includes laws, regulations, instructions, and decisions issued by the administration in Iraq and in comparison countries that have a relationship with the means of administration when selecting a contractor, as well as the judgments of the judiciary and opinions of jurists in this regard.
The appropriate method of contracting.

L’étude a pour objet la recherche des moyens dont dispose l’administration Irakienne dans la lutte contre la corruption administrative et financière dans la phase du choix de son contractant et ce ،en se référant aux exemples Français et Egyptien.
Une telle étude permet de cerner avec precision les écueils que rencontre l’administration pendant la phase du choix du contractant et de tenter ainsi d’y remédier.
