تهتم جميع دول العالم بالموارد الطبيعية و على وجه الخصوص الموارد المائية التي تعد عنصرا حيويا للإنسان بقاؤها مرهون على ديمومتها و استدامتها فضلا عن ذلك فهي تشكل عنصرا تنمويا و استراتيجيا للدول حيث تحول ترشيد استغلال و استعمال الموارد المائية و كذا حمايتها من انحرافات الأشخاص أمرا ضروريا قصد تجنب إصابتها بأضرار و أخطار التلوث لاسيما مخلفات البواخر و السفن و كذا المواد التي تفرزها الوحدات الصناعية و الاقتصادية.
أدرك المشرع الجزائري على غرار باقي التشريعات الدولية مدى أهمية هذه الموارد و ضرورة حمايتها من التلوث وضمان الصحة العمومية لذلك كرس ترسانة من النصوص القانونية و التنظيمية التي تعمل على ضبط استغلال المياه و كذلك حمايتها من التصريف غير القانوني وغير العقلاني وقد تنوعت الأليات الموظفة في عملية ترشيد الاستغلال المياه أبرزها الترخيص بالتصريف.

Abstract EN
Natural resources, in particular water resources, have become a centre of interest for states, because they are vital resources for human beings, their survival depends on their permanence and sustainability.
In addition, they constitute a development and strategic element.
The rationalization of the exploitation and use of water resources, as well as their protection against misuse, has become necessary, in order to avoid being harmed by the dangers of pollution, in particular with materials such as waste from ocean liners and ships, as well as materials produced by industrial and economic units.
Algeria has realized the importance of these resources and the need to protect them from pollution.
Consequently, the legislator has consecrated an arsenal of laws which aim to control the exploitation of water, as well as to protect it against the illegal and irrational discharge of effluents.

Les ressources naturelles, en particulier les ressources en eau, sont devenu un centre d’intérêt pour les Etats, car c’est des ressources vitales pour l'être humain, sa survie dépend de leur permanence et durabilité.
De plus, ils constituent un élément de développement et stratégique.
La rationalisation de l'exploitation et de l'utilisation des ressources en eau, ainsi que leur protection contre le mauvais usage, est devenu nécessaire afin d'éviter d'être lésé par les dangers de la pollution, en particulier avec des matériaux tels que les déchets des paquebots et des navires, ainsi que des matériaux produits par des unités industrielles et économiques.
L'Algérie s’est rendu compte de l'importance de ces ressources et la nécessité de les protéger de la pollution.
C’est pourquoi, le législateur a consacré un arsenal juridique qui vise à contrôler l'exploitation de l'eau, ainsi que sa protection contre le rejet illégal et irrationnel d’effluents.
