تعتبر جرائم المخدرات و المؤثرات العقلية من اخطر الجرائم التي ترتكب في اطار مشروع اجرامي جماعي قائم على مخطط و تنظيم محكم و ادراكا لخطورة الوضع أجاز المشرع لضباط الشرطة القضائية إذا دعت ضرورات التحقيق الابتدائي في جرائم المخدرات و المؤثرات العقلية أن يوقفوا للنظر أي شخص مشتبه فيه في اماكن لائقة بكرامة الانسان و مخصصة لذلك لمدة لا تتجاوز 48 ساعة مع امكانية تمديد حجزه إلى مدة لا تتجاوز ثلاث مرات المدة الأصلية لتصبح 192 ساعة و هو ما يعادل 8 أيام.
نظرا لخطورة هذا الاجراء و مساسه بالحرية الفردية للشخص أحاطه المشرع بعدة ضمانات و الزم ضابط الشرطة اخبار الشخص الموقوف بالحقوق المقررة له قانونا كحقه في اجراء فحص طبي و حقه في الاتصال بعائلته و بمحاميه و بزيارتهما له.

Abstract: The crime of narcotic drugs and psychotropic substances is considered one of the most serious crimes committed in collective criminal project based on strict planning and regulation.
In regard of the seriousness of the situation, The legislator authorized the judicial police officers, if necessary to preliminary investigate any suspect In places of human dignity dedicated for 48 hours, with the possibility of extending the detention to a period not exceeding three times the original period which become 192 hours, equivalent to 8 days.
In view of the seriousness of this procedure and the non-respect of individual’s freedom of the person, the legislator has been surrounded it by a number of guarantees, and he obliged that The police officer must inform the arrested person of the rights prescribed for him by law, such as his right to a medical examination and the right to contact his family and his lawyers.

Les infractions de stupéfiants et de substances psychotropes sont considérées parmi les plus graves infractions commises dans le cadre d'un projet criminel collectif, reposant sur un planning et une organisation judicieuse.
Conscient de cette gravité, le législateur a autorisé les officiers de police judiciaire, selon les besoins et dans le cadre de l’enquête préliminaire, à enquêter sur toute personne suspecte et de la placer en garde à vue, dans des locaux appropries à la dignité humaine et destinés à cet effet, pendant 48 heures et de pouvoir prolonger cette détention jusqu’à trois fois la période initiale , qui deviendra 192 heures, ce qui équivaut à 8 jours .
Compte tenu de la gravité de cette procédure et l’atteinte à la liberté individuelle des personnes, le législateur a confiné cette procédure par plusieurs garanties et a astreint l’officier de police d’informer la personne placée en garde à vue de ses droits, notamment son droit à un examen médical et son droit de contacter sa famille et son avocat et de les recevoir en visite.
