The legislator has subjected public contracts to control, because of their importance and their relation to public funds.

This control, to which these public contracts are subject, is carried out in several forms: internal, external and guardianship control.

And despite the fact that the legislator insisted on the need to control these public contracts, reality has shown the spread of the phenomenon of financial corruption, for the reasons that these public contracts were awarded to people who did not meet the necessary conditions; of the beautifier of the public market so that it appears in the eyes of the controllers as an apparently legitimate market, that is to say the respect of the regulations in terms of form, when in fact it was carried out by the means of benefiting the partner beforehand with superlative information or of benefiting it later on under specific execution conditions.
