By virtue of Executive Decree No.

14-70 of 10/02/2014, laying down the terms and conditions for the rental of waqf land intended for agriculture, the Algerian legislator has to introduce a specific rental regime for the exploitation of the agricultural wakfs land restituted by the state which have been exploited in the form of agricultural exploitation under the concession contract in accordance with the provisions of Law 10-03 of 15/08/2010 laying down the conditions and modalities for the exploitation of agricultural land which are private State property.

After restoring the agricultural land Exploited by the agricultural exploitation and classifying them as Waqfs, the legislator tried to maintain the same farming system and the same farms by converting the previous exploitation mode, perpetual right of use or concession right, to this special tenancy scheme, governed by a contract between the member of the collective or individual agricultural exploitation, on the one hand, and the national agricultural land office and the wakfs authority, on the other hand, attached to a schedule of conditions for a period of 40 years, renewable at an annual rent of the same value as the concession contract identified and collected and awarded under the finance law.
