The effect of kinship on aggravating the penalty : the case of rape crime

Rape is one of the most serious and most heinous crimes that threaten the family's entity and break the morality and structure of society, especially if committed from one of the victim's ascendants.

The Algerian legislator moved therefore quickly to sentence the perpetrators with severe penalties because these acts were considered to be a deviation from the human common sense, given the trust and mutual respect that these family ties require.

From this perspective, our study aimed to learn about the punitive policy of our own legislator to protect these ties.
