Abstract EN

The delay took on a particular dimension in the air transport contract.

The passenger searches for speed in order to arrive with his luggage on time.

This made him choose "the plane" because of its speed advantage.

Failure to respect the deadlines will result in the termination of this advantage, to which will be added countless damages.

Responsibility shall be borne by the air carrier, who shall compensate the traveler for the damage caused by the delay.

For this reason, the Warsaw Convention of 1929 entered into force to regulate the provisions of this responsibility, which was adopted by the Algerian Civil Aviation Law in view of the amended Law 98/06.

The aim of this study is to clarify the provisions concerning air carrier responsibility for delays in the arrival of passengers and their luggage, in accordance with the Algerian Law in force.
