The principle of the unconstitutionality of laws is a new mechanism of remote control of laws in the Algerian legal system and is a means to ensure that the rights and freedoms of individuals are protected from infringement.

And the freedoms guaranteed by the Constitution as stipulated in Article 188 of the Constitutional Amendment 2016.

For the first time, litigating citizens have the right to challenge the unconstitutionality of legislative rulings before the competent courts, which in turn submit the matter to the Supreme Judicial Authority to ensure the seriousness of the payment or not, and the possibility of notifying the ConstitutionalCouncil about the text to be applied to the subject of the original case.
