The question of naturalization of non-Islamic nationality is a thorny issue in contemporary life, where multiple forms of naturalization are different according to the different conditions, and this result in the difference of scholars in the ruling on the issue.

The research offers a jurisprudential study of one of the forms of naturalization linked to the conditions of French colonialism in Algeria, Articles and fatwas of Imam Abdul Hamid Ibn Badis, where the mechanisms of his jurisprudence are highlighted according to the facts of the reality of Algeria and according to a specific vision of the provisions of the Shari'a distinguished by the Maliki doctrine.
