Abstract EN

The legal recharacterization of facts is a procedure which aimes to make a correct application of the law, via using the appropriate text which is applicable upon the deferred facts to the first instance criminal court.

It is a compulsory procedure and the criminal court is given this prerogative on the basis of objective and procedural considerations, particularily the observance of the principle of legality of offences and sanctions.

The effect of recharacterization of facts upon the material scope of the criminal action is apparent, in some cases where the first instance criminal court is allowed to recharacterize without modifying the facts deferred to it.

But in some specific cases, the criminal court is not ollowed to take this procedure.

And among other effects of recharacterization, the fact that it is inadmissable to proceed to a trial on the some acts a second time even whith a new legal recharacterization, and the law requires that the defence must be informed about this recharacterization and the judjement should be formulated on this basis.
