Making an arrest against a suspect is considered One of the most dangerous measures that can be taken during the preliminary investigation stage, in which the suspect is deprived of liberty for a period of time, and this matter is opposes the fact that he is an innosent personuntil it proves otherwise.

However, despite this violation of the suspect's individual liberty, the legislator has authorized resorting to it as a procedural means that can help the judicial police officers to reach the truth, maintain the public interest, and achieve effective criminal justice, whether it is related to investigations.

In ordinary cases, or cases of flagrante delicto, and in view of its seriousness, the legislator made his practice restricted, by setting a set of guarantees and controls to protect the individual freedom of the suspect from arbitrariness.
