This article seeks to determine the criteria for the concept of fundamental freedom, which is purposed by the procedural legislation for expeditious judicial protection.

The study has revealed the multiplicity of jurisprudential and judicial standards in the interpretation of the basic freedom intent, which the administrative urgency judge can rely on.

The study concluded that the judicial practice of the French administrative judiciary is stable on a set of criteria that can be relied upon in describing freedom as fundamental.
