تتناول هذه الدراسة موضوع جريمة الرشوة الانتخابية في ظل أحكام القانون العضوي رقم 16-10 المؤرخ في 25-08-2016 المتعلق بنظام الانتخابات المعدل و المتمم باعتبارها واحدة من أبرز الجرائم التي تؤثر سلبا على نزاهة و شفافية العمليات الانتخابية المختلفة كونها تمس إرادة الناخبين بصفة مباشرة و تؤثر على أرائهم السياسية فتنتقص من مبدأ حرية التصويت أو تلغيه حيث تصدى لها المشرع الجزائري ضمن مختلف القوانين الانتخابية المتواترة مبينا الأركان التي تقوم عليها و كذا العقوبات المقررة لها إضافة إلى الأحكام المتعلقة بظروف التشديد و التخفيف في العقوبات و الإعفاء منها طالما توفرت شروط ذلك

This study tackles the issue of the crime of electoral bribery in light of the provisions of the Organic Law No.
16-10 of 25-08-2016 related to the amended and supplemented election system as one of the most prominent crimes that adversely affect the integrity and transparency of different electoral processes, as it directly impacts on the will of voters and their political opinions, it detracts from the principle of free voting or cancels it, as the Algerian legislator addressed it with several recurring electoral laws stating the pillars on which they are based, as well as the provided penalties, however to the provisions related to the circumstance of aggravation, mitigation or exemption from penalties once the conditions are available.
