استقلالية السلطة القضائية هي أحد أهم الضمانات التي تقوم عليها دولة القانون لذلك اعتبرها الدستور الجزائري أحد المبادئ التي تقوم عليها الدولة الجزائرية إذ تشكل عنوان النظام الديمقراطي القائم على العدل و الانصاف و الفصل التام بين السلطتين التشريعية و التنفيذية و الخضوع لروح القانون دون أي ضغوط في سن الأحكام و القرارات القضائية.
تقتضي الاستقلالية القضائية التمتع بالاستقلالية العضوية والوظيفية سنعالج من خلال هذا المقال مدى الاستقلالية الفعلية للسلطة القضائية في الجزائر
Abstract EN
The independence of the judiciary power is one of the most important guarantees for the establishment of the State of law.
This is considered by the Algerian constitution one of the principles on which the Algerian state is based.
It is the title of a democratic system based on justice, equity, and the total separation of the legislative and executive powers and submission to the spirit of law without any pressures in enacting judgments and judicial decisions.
Due to the enjoyment of organic and functional independence devoted by the law.
we will treat through this article the extent of the effective independence of the judiciary power in Algeria.
