Abstract EN

The regulation of the presidential vacancy is related to the constitutional system nature.

For this reason, this article attempts to highlight the constitutional framework for the management of this situation in North African countries, namely Algeria, Egypt and Tunisia, with strict presidential systems, through assessing the ability of relevant provisions to achieve necessary balance between the continuity of the State requirements and the guarantees of peaceful transfer of power.

Through the historical-descriptive approach, this study intends to deal with constitutional regulation of the vacancy situation in the aforementioned countries before the crisis period, then reviews the following practices and experiences.

This research tries to assess the impact of these developments on the post-crisis constitutional texts.

Then, the conclusion is about underlining the necessity of improving presidential vacancy management as an imperative to avoid political crisis.

It provides recommendations aimed at achieving the required balance by ensuring constitutional system effectiveness and maintaining stability
